Parties and subject matter<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">NV Etablissementsen Van Moer (hereinafter referred to as &#8217;the Etablissements Van Moer&#8217;)&#8221; or the &#8220;&#8221;)Rue de Vaart 702235 HulshoutBelgium<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">KBO\/VAT: 0403,629,965Email: info@vanmoer.bePhone number: +32 (0)15 25 86 20<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Van Moer establishes this Privacy Policy, which aims to inform users transparently about the website hosted at the following address: www.vanmoer.be, (hereinafter the &#8220;&#8221;), and how personal data are collected and processed by Van Moer.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The term &#8220;&#8221; refers to any user, whether natural or legal, who visits the Site or communicates with the Site in any way.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In his capacity as a controller, Van Moer determines all technical, legal and organizational means and the purposes for the processing of Users&#8217; personal data. Van Moer undertakes to take all necessary measures to ensure that the processing of personal data takes place in accordance with the Law of 30 July 2018 on the protection of individuals with regard to the processing of personal data (hereinafter the &#8220;&#8221;) and Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46\/EC (i.e. the General Data Protection Regulation (GDPR) or the General Data Protection Regulation (GDPR), hereinafter referred to as &#8220;the &#8220;&#8216;).<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Van Moer is free to choose a natural or legal person who processes the user&#8217;s personal data at his request and in his name (hereinafter the &#8220;processor&#8221; or &#8220;subcontractor&#8221;). Where appropriate, Van Moer undertakes to select a Processor that provides sufficient guarantees regarding technical and organisational measures for the processing of personal data, in accordance with the Law and the Regulation.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>2. Processing of Personal Data<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The use of the Site by the Users may lead to the collection of personal data. The processing of this data by Van Moer, in his capacity as Controller or by service providers operating in the name and on behalf of Van Moer, is carried out in accordance with the Law and the Regulation.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Personal data are processed by Van Moer, in accordance with the purposes listed below, using the following methods:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Sending our newsletter and\/or advertising leaflet <\/li>\n\n\n\n<li class=\"has-small-font-size\">To contact you by phone or email if necessary in order to carry out our services<\/li>\n\n\n\n<li class=\"has-small-font-size\">To inform you about changes to our services and products <\/li>\n\n\n\n<li class=\"has-small-font-size\">Van Moer analyses your behavior on the website in order to improve the website and tailor the offer of products and services to yourpreferences<\/li>\n\n\n\n<li class=\"has-small-font-size\">By applying for a job at Van Moer we collect the information you provide us, such as identity data, CV and application letter.<\/li>\n<\/ul>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>3. Purposes of Processing Personal Data<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 13 of the Regulation, the purposes of the processing of personal data shall be communicated to the User. These objectives are the following:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">Sending our newsletter and\/or promotional materials, based on your consent as the legal\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0<br\/>basis.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0<\/li>\n\n\n\n<li class=\"has-small-font-size\">To contact you by phone or email where necessary for the performance of our services, based on your consent as the legal basis<\/li>\n\n\n\n<li class=\"has-small-font-size\">To enable you to create an account, based on your consent as the legal basis<\/li>\n\n\n\n<li class=\"has-small-font-size\">We monitor your browsing behavior across different websites in order to tailor our products and services to your needs, based on your consent as the legal basis.<\/li>\n<\/ul>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>4. Personal Data We May Process<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User agrees that, during the visit and use of the Site, Van Moer collects and processes the following personal data:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">First and last name<\/li>\n\n\n\n<li class=\"has-small-font-size\">Address details <\/li>\n\n\n\n<li class=\"has-small-font-size\">Phone number <\/li>\n\n\n\n<li class=\"has-small-font-size\">Email address <\/li>\n\n\n\n<li class=\"has-small-font-size\">Other personal data that you actively provide, for example by creating a profile on this website, in correspondence and by telephone <\/li>\n\n\n\n<li class=\"has-small-font-size\">Data about your browsing behavior across different websites (for example because this company is part of an advertising network) <\/li>\n\n\n\n<li class=\"has-small-font-size\">Internet browser and device type<\/li>\n<\/ul>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Van Moer collects and processes these personal data in accordance with the terms and principles described in this Privacy Policy.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>5. Consent<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">By accessing and using the Site, the User declares that he\/she has given his\/her free, specific, informed and unambiguous consent to the processing of his\/her personal data. This Agreement concerns the content of this Privacy Policy.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Permission is given by the positive and active action by which the User has checked the privacy policy box in &#8216;hypertext link&#8217;. This consent is an essential condition for performing certain actions on the Site or to enable the User to enter into a contractual relationship with Van Moer. Any agreement that Van Moer and a User connect regarding the services and goods offered on the Site is subject to the User&#8217;s acceptance of the Privacy Policy.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User agrees that the Controller, in accordance with the terms and principles contained in this Privacy Policy, collects and processes his\/her personal data that he\/she provides on the Site or in connection with the services offered by Van Moer for the purposes mentioned above.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User has the right to withdraw this consent at any time. The withdrawal of the consent shall be without prejudice to the legality of the processing on the basis of the prior authorization.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>6. Retention Period of Users\u2019 Personal Data<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 13 (2) of the Regulation, the controller shall store the personal data only for as long as reasonably necessary to achieve the purposes for which they are processed.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In all cases, this duration shall not exceed two years.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>7. Data Recipients and Disclosure to Third Parties<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Personal data may be transferred to employees, employees, subcontractors, processors or suppliers of Van Moer insofar as adequate guarantees are provided for the security of the data and insofar as they cooperate with Van Moer for the marketing of the products or the provision of services. They act under the direct authority of Van Moer, and are responsible in particular for the collection, processing or outsourcing of this data.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In all cases, the recipients of the data and those to whom the data are provided shall comply with the content of this Privacy Policy. Van Moer ensures that they process this data only for the intended purposes and in a discreet and secure manner.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In the event that the data would be provided to third parties for purposes of direct marketing or prospecting, the User will be informed in advance so that he or she can give the prior and express consent to this use of personal data.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>8. Users\u2019 Rights<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User may exercise his rights at any time by sending a message by email to the following address: info@vanmur.be, or a letter by post accompanied by a copy of his or her identity card at the following address:70 Vaartstraat, 2235 Hulshout.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>a. Right of Access<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 15 of the Regulation, Van Moer guarantees the right of the User to access his personal data. The User has the right to access these personal data and the following information:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">the categories of personal data concerned;<\/li>\n\n\n\n<li class=\"has-small-font-size\">the recipients or categories of recipients to whom the personal data are or will be provided;<\/li>\n\n\n\n<li class=\"has-small-font-size\">where the recipients are established in third countries or international organizations, the appropriate or appropriate safeguards;<\/li>\n\n\n\n<li class=\"has-small-font-size\">where possible, the proposed storage period for personal data or, where this is not possible, the criteria for establishing that period;<\/li>\n\n\n\n<li class=\"has-small-font-size\">the existence of automated decision-making, including profiling, as referred to in Article 22 (1) and (4) of the Regulation, and, at least in such cases, relevant information on the underlying logic, as well as the importance and expected impact of such processing on the data subject.<\/li>\n<\/ul>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The Controller may require a reasonable fee based on the administrative costs for additional copies requested by the User.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">When the User submits this request electronically (e.g. via the e-mail address), the data shall be provided in electronic form and for general use, unless the User so requests.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The copy of the data will be communicated to the User within one month of receipt of the request.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>b. Right to Rectification<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Van Moer guarantees the right to rectification and deletion of personal data to the User.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or deleted at any time. The User first makes the necessary changes from his user account, unless they cannot be made independently, in which case the request can be addressed to Van Moer.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 19 of the Regulation, the controller shall notify any recipient to whom the personal data have been provided of any rectification of the personal data, unless such rectification proves impossible or requires disproportionate efforts. The controller shall provide the data subject with information on those recipients if the data subject so requests.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>c. Right to Erasure<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User shall have the right to obtain the deletion of his personal data as soon as possible in the cases referred to in Article 17 of the Regulation.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Where the controller has disclosed the personal data and is obliged to erase them pursuant to the previous paragraph, the controller shall take reasonable measures, taking into account available technologies and implementation costs, including technical measures, to other controllers who process such personal data, inform that the data subject has requested controllers to delete the link with such personal data or a copy or reproduction thereof.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The two preceding paragraphs shall not apply to the extent that such processing is necessary:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"has-small-font-size\">For the exercise of the right to freedom of expression and information;<\/li>\n\n\n\n<li class=\"has-small-font-size\">to comply with a legal obligation to process under Union law or the law of the Member State to which the controller belongs, or to carry out a task of general interest or in the exercise of public authority entrusted to the controller;<\/li>\n\n\n\n<li class=\"has-small-font-size\">the determination, exercise or defence of actions.<\/li>\n<\/ul>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 19 of the Regulation, the controller shall inform any recipient to whom the personal data have been provided of any deletion of personal data or any restriction on their processing, unless such disclosure proves impossible or involves disproportionate effort. The controller shall provide the data subject with information on those recipients if the data subject so requests.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>d. Right to Restrict Processing<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User shall have the right to restrict the processing of his personal data in the cases referred to in Article 18 of the Regulation.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 19 of the Regulation, the controller shall inform any recipient to whom the personal data have been provided of any restriction on the processing carried out, unless such disclosure proves impossible or involves disproportionate effort. The controller shall provide the data subject with information on those recipients if the data subject so requests.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>e. Right to Data Portability<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">In accordance with Article 20 of the Regulation, Users have the right to receive their personal data from Van Moer in a structured, commonly used and machine-readable format. Users have the right to transfer this data to another controller without preventing Van Moer from doing so, in the cases provided for in the Regulation.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Where the User exercises his right to data portability under the previous paragraph, he shall have the right to have personal data transferred directly from one controller to another, to the extent technically possible.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The exercise of the right to data portability shall be without prejudice to the right to delete data. This right shall not apply to the processing necessary for the performance of a task of general interest or for the exercise of the public authority entrusted to the controller.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The right to data portability does not affect the rights and freedoms of third parties.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>f. Right to Object and Automated Individual Decision-Making, including Profiling<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User has the right at any time to object to the processing of his\/her personal data due to his\/her specific situation, including the automation of data by Van Moer. In accordance with Article 21 of the Regulation, Van Moer will no longer process personal data unless there are legitimate and compelling reasons for the processing that prevail over the interests and rights and freedoms of the User, or for the establishment, exercise or defence of legal rights.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">When processing personal data for prospecting purposes, the User shall at any time have the right to object to the processing of personal data concerning him for such prospecting purposes, including profiling in so far as it relates to such prospecting.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Where the data subject objects to the processing for the purpose of prospecting, the personal data shall no longer be processed for that purpose.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>g. Right to Lodge a Complaint<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The User has the right to lodge a complaint concerning the processing of his personal data by Van Moer, to the Data Protection Authority responsible for the Belgian territory. Cookies<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The Site uses cookies to distinguish Users from the Site. This makes it possible to offer users a better browsing experience and an improvement of the Site and its content. The objectives and methods of cookies are set out in this article.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><em>a. General Principles<\/em><\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">A &#8220;<strong>Cookie<\/strong>&#8221; is a file that is temporarily or permanently placed on the User&#8217;s device when viewing the Site for a subsequent connection. They also allow Van Moer to identify and correct any bugs on the Site;<\/li>\n\n\n\n<li class=\"has-small-font-size\">Functional cookies: These cookies facilitate the use of the Site by maintaining certain entered choices (e.g. user name or language);<\/li>\n\n\n\n<li class=\"has-small-font-size\">Tracking cookies: Van Moer uses tracking cookies via Google Analytics to measure the interaction of users with the content of the Site and to produce anonymous statistics. These statistics allow Van Moer to improve the Site. Limitation of Liability of the Data Controller<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The website may contain links to other third party websites that are not linked to Van Moer. The content of these sites and compliance with the Regulation and the Law are not the responsibility of Van Moer.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The holder of parental authority must give his or her express consent to the minor under 16 years of age to disclose personal information or data through the Site. Van Moer strongly recommends individuals exercising parental authority over minors to promote responsible and safe use of the Internet.The controller may not be held liable for the collection and processing of personal information and data of minors under 16 years of age whose consent is not effectively covered by that of their legal parents, nor for incorrect data &#8211; in particular as regards age &#8211; imported by minors. Under no circumstances will personal data be processed by the Controller if the user indicates that he\/she is under 16 years of age.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">Van Moer is not responsible for the loss, damage or theft of personal data, particularly as a result of the presence of viruses or after computer attacks.<\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\"><strong><br\/>11. Security<\/strong><\/p>\n\n<p class=\"has-small-font-size wp-block-paragraph\">The controller shall implement technical and organizational measures to ensure an appropriate level of security for the processing and collection of data.
